1. Registration and Usage Terms
The registration and use of domain names is subject to acceptance of the present Domain Names Policy as well as the sponsoring Registrar’s terms and conditions, as follows:
Namecheap, Inc: https://www.namecheap.com/legal/
Foxpress.io Hosting (hereinafter “Foxpress“) will, at its own discretion, determine which sponsoring Registrar will be used to register the requested domain name. You can determine which Sponsoring Registrar was used to register your domain by performing a WHOIS verification on your domain name following its registration.
2. Availability and Registration
Foxpress can only register on your behalf domain names that have not already been registered and thus are deemed to be available. You can verify any domain’s availability on the Foxpress web site, using the Domain Names Search Tool. Foxpress makes no guarantee as to the accuracy of the results provided by the Domain Name Search tool. Once a domain has been found to be available, it can be reserved by completing the online order form on the Foxpress web site. Payment of a domain name registration does not immediately guarantee the registration of that domain. You will be sent a domain registration confirmation once Foxpress has confirmed your registration, normally within 24 hours of your order. In the event that a purchased domain name is not available or cannot be registered, our support staff may assist you in finding an alternate available domain name, or refund your purchase.
You are solely responsible for renewing your domain names with Foxpress before their expiration date. Foxpress will issue renewal notices and renewal invoices by email prior to your domain’s expiry date in order to facilitate the renewal process, and will attempt to renew domains on your behalf following receipt of payment. Foxpress will send you a confirmation email once the domain has been successfully renewed. If you have a valid credit card on file with us and have configured your account to automatically charge renewals to your credit card, Foxpress will automatically charge your credit card 5 days prior to your domain name’s due date for an additional term.
In most cases, expired domain names can be renewed for up to 30 days following their expiration at the regular registration fee; however, due to varying conditions based on the type of domain purchased (also known as Top-Level Domain, or “TLD”), Foxpress cannot guarantee the successful renewal of an expired domain name. Foxpress will make all reasonable efforts to secure a domain’s renewal once payment is received, but cannot guarantee any specific results. In the event that a paid renewal cannot be completed, paid renewal fees will be refunded.
Certain TLDs expired for more than 30 days enter a special state called a “Redemption Period” in which they may not be transferred or renewed. The Client may reactivate a domain name in its Redemption Period at a cost starting at 300$ CAD, plus regular registration fees, plus taxes, by contacting a sales representative.
4. Domain Agent Authorization
By having your domain registered with Foxpress.io Hosting as of December 1, 2016, you are authorizing Foxpress to act as your Designated Agent and to authorize registrant contact information changes on your behalf. This basically means you’ll be able to enjoy a streamlined contact information change process (essentially the same process you’re already using from our secure Client Area), while still retaining full ownership of your own domain.
Once registered or renewed successfully, domain names are non-refundable and are not eligible for refund through Foxpress’s money-back satisfaction guarantee. Paid domain name registrations, transfers, or renewals that could not be completed can be refunded following a written request submitted within 30 days of initial payment..
6. Limitation of Liability
Foxpress is not responsible for any losses caused directly or indirectly by errors resulting from incorrect configuration or handling of the domain name, beyond the initial yearly registration, transfer, or renewal fees paid at the time of registration, transfer, or renewal.
7. Zone Modifications
You may arrange special configurations of your domains (globally known as Zone Modifications, but often also referred to as CNAME, A, MX or PTR Record changes) through your secure Foxpress Client Area. In such cases, you understand that incorrect configuration of your domain name may result in an inaccessible web site and agree to use this interface at your own risk.
8. Dispute Resolution Policy
Please refer to ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP) for the official policies with respect to a complaint about the registration or phrasing of a domain name that may be infringing trademarks. In the case of .CA domains, please refer to CIRA’s CDRP Process. As a domain registrar, Foxpress.io Hosting cannot directly intervene or pass judgement in domain disputes.
9. TLD-Specific Terms & Conditions
.com, .net, .org, and .biz Domains
.com, .net, .org, and .biz domains must comply with ICANN’s terms and regulations: https://www.icann.org/resources/pages/policy-2012-02-25-en.
.CA domains must comply with CIRA’s terms and conditions: http://cira.ca/sites/default/files/attachment/policies/registrationrules.pdf.
.CA registrations require that you confirm your information on the CIRA web site, as per the instructions that will be sent to your administrative email address within 24 hours after the order is placed. Failure to complete this confirmation within the allocated time period will result in a canceled order. In the event of a canceled registration, you may request that Foxpress re-submit the registration request to CIRA, granting you a 7-day extension to complete the confirmation process. In some cases, the registration will be completed without an additional confirmation process being requested.
.CA registrations are reserved for Canadian residents and businesses. Non-residents may see their registration refused or terminated without prior notice and/or refund. See the complete CIRA terms for details.
Personal information may be withheld from the public WHOIS database by activating the .ca privacy option with CIRA. Please contact CIRA directly for additional information and conditions.
.ME domains must comply with .ME’s terms and conditions: http://domain.me/policies/
